REGULATIONS
I. Definitions
The terms used in the Regulations shall mean:
- Customer – a natural person, legal person or organizational unit that is not a legal person, whose specific provisions grant legal capacity, who places an Order as part of the Store.
- Consumer – in accordance with Civil Code, law 287/2009, means, a natural person who concludes a legal transaction with an entrepreneur not directly related to his business or professional activity.
- Civil Code – Law 287/2009 and subsequent amendments.
- Regulations – these Regulations defining the general terms and conditions of sale and the rules for the provision of electronic services as part of the boxmag.eu Online Store
- Online Store (Store) – an online service available at boxmag.eu, through which the Customer may, in particular, place Orders.
- Goods – products presented in the Online Store.
- Sales Agreement (Agreement) – a contract for the sale of Goods within the meaning of the Civil Code, concluded between the boxmag.eu and the Customer, concluded using the Store's website.
- Consumer Rights Act – Law 363/2007, direction 85/577/CEE on consumer right.
- Act on the provision of electronic services – law 365/2002 , regarding electronic services.
- Order – the Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Goods.
II. General provisions
- These Regulations define the rules for using the Online Store available at boxmag.eu.
- These Regulations are the Regulations referred to the law 365/2002( as amendments) regarding the electronic services.
- The boxmag.eu is part of REKO Packaging s.r.l , Stefan cel Mare 131 street, 725400-Radauti,Suceava, VAT NR. RO4534966, registered at chambre of commerce with nr. J33/1437/1993
- These Regulations define in particular: - the rules for registering and using an account as part of the Online Store- the terms and conditions for placing Orders electronically as part of the Online Store- the rules
for concluding Sales Agreements using the services provided as part of the Online Store. - In accordance with applicable law, boxmag.eu reserves the right to limit the provision of services via the Online Store to persons over the age of 18. In this case, potential customers will be notified.
- Customers can access these Terms and Conditions at any time via a link on the home page of the boxmarket.eu website and download and print it.type and quantity of the Goods.
III. Rules for using the Online Store
- Registration in the Online Store is optional. The Customer may place an order without registering in the Store, after reading these Regulations and accepting them. Registration takes place by completing and
accepting the registration form, made available on one of the Store's websites.The condition for registration is to agree to the content of the Regulations and provide personal data marked as mandatory. Boxmag.eu may deprive the Customer of the right to use the Online Store, as well as may limit his access to part or all of the resources of the Online Store, with immediate effect, in the event of a breach by the Customer of the Regulations, and in particular when the Customer: - provided during registration in the Online Store data that is untrue, inaccurate or outdated, misleading or violating the rights of third parties, - committed through the Online Store infringement of personal rights of third parties, in particular personal rights of other Customers of the Online Store, - commits other actions that will be recognized by the boxmag.eu as behavior inconsistent with applicable law or general principles of using the Internet or harming the good name of boxmag.eu.A person who has been deprived of the right to use the Online Store, may not re-register without the prior consent of the boxmag.eu. - In order to ensure the security of the transmission of messages and data in connection with the services provided on the website, the Online Store takes technical and organizational measures appropriate to the
degree of threat to the security of the services provided, in particular measures to prevent unauthorized persons from obtaining and modifying personal data sent on the Internet. - The Customer is obliged in particular to: - use the Online Store in a manner consistent with the provisions of the law in force in the Romanian country, the provisions of the Regulations, as well as with the general principles of using the Internet, - not to provide or transfer content prohibited by law, e.g. content promoting violence, defamatory or violating personal rights and other rights of third parties, - using the
Online Store in a manner not interfering with its functioning, in particular through the use of specific software or devices, - not taking actions such as: sending or placing unsolicited commercial information (spam) as part of the Online Store, - using the Online Store in a way that is not inconvenient for other Customers and for boxmag.eu, - using any content posted as part of the Online Store only for personal use. - The customer agrees to receive invoices in an electronic version.
IV. Procedure for concluding a Sales Agreement
- In order to conclude a Sales Agreement via the Online Store, one must go to the boxmag.eu website and select the Goods by taking further technical steps based on the messages displayed to the Customer and
information available on the website. - The selection of ordered Goods by the Customer is made by
- When placing an Order – until the button confirming the Order is pressed – the Customer has the option of modifying the entered data and the selected Goods. For this purpose, the Customer should be guided by
the messages displayed to the Customer and the information available on the website. - After the Customer using the Online Store provides all the necessary data, a summary of the Order placed will be displayed. The summary of the Order placed will include, m.in. a description of the selected Goods or services, the total price and all other costs.
- In order to send the Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the button confirming the placement of the Order.
- Information about the Goods provided on the Store's websites constitutes an offer within the meaning of the Civil Code. Sending the Order by the Customer is a declaration of will to conclude a Sales Agreement with boxmag.eu, in accordance with the Regulations.The Agreement is treated as concluded at the moment of receipt of the Customer's Order to the IT system of the Online Store, provided that the Order complies with the Regulations.After the conclusion of the Agreement, the Customer receives an e-mail confirming all
essential elements of the Order. - Customers can access these Terms and Conditions at any time via a link on the home page of the boxmag.eu website and download and print it. Consolidation, securing, making available and confirmation to the Customer of the essential provisions of the Goods Sales Agreement takes place by sending the Customer to the e-mail address provided.
V. Delivery
- Delivery of the ordered Goods is carried out in accordance with the information in the Delivery tab, which is available at the URL: https://boxmag.eu/en/content/delivery
- The cost of delivery of the Goods will be indicated when placing the Order. In the basket during the finalization of the Order, the final cost of delivery of the Order is given.
- It is possible to collect the ordered Goods in our Store: Boxmag, Stefan cel Mare 131 street RO-725400 Radauti, Suceava, from Monday to Friday from 8:00 to 16:30, except for public holidays.
- The order can be picked up after prepayment and receiving an e-mail confirming the possibility of receiving the ordered Goods
- Orders are processed after receipt of confirmation of payment. Until the confirmation of Orders are not processed.
- Paid Orders are processed from Monday to Friday during warehouse working hours.
- The Order completion date depends on the availability of the Goods in stock. Information about the estimated delivery time of the Order is provided in the product card. For products marked as 24 hours
Shipping, the execution is until the next business day. For products marked as Shipping up to 5 business days, the execution is up to the fourth business day. The time of delivery of the Order by the carrier depends on the place of delivery of the Order. - Damage to the Goods caused during delivery. In the case of consumer distance purchase, our Store always bears the risk of accidental damage or loss of the Goods in transit. If the Goods are delivered with
obvious damage caused during transport, we kindly ask you to report such a defect to the deliverer as soon as possible and contact us. A delay in filing such a complaint or making contact has no consequences for your statutory claims and their satisfaction, in particular for your rights under the statutory warranty for defects (point VIII of the Terms and Conditions). Faster notification of noticed damage caused during
transport is an assistance for us in pursuing our own claims against the carrier or transport insurer. - In the case of a Customer who is not a Consumer at the same time: the risk of accidental damage or loss of the Goods passes from the Online Store to the buyer at the time of entrusting the Goods to a carrier
engaged in the transport of goods of a given type, or a person or courier company designated by the buyer.
VI. Prices and payment methods
- The prices of the Goods are quoted in RON and EUR in accordance with the User's settings. Payments are accepted in currencies that the User chooses from the available list in the Store in accordance with their
preferences. - All prices include VAT.
- The Customer has the option of paying for the Order with the payment methods listed in the How to buy tab available at the URL https://boxmag.eu/en/content/how-to-buy
- The Order Fee is charged after placing the Order.
- Only paid Orders are accepted for execution.
VII. Right of withdrawal
You have the right to withdraw from this Agreement within 14 days without giving any reason. The withdrawal period expires 14 days after the date on which you came into possession of the last batch or part or on which a third party other than the carrier and indicated by you came into possession of the last batch or part.
To exercise your right of withdrawal, you must inform us (Boxmag, Stefan cel Mare 131 street RO-725400 Radauti, Suceava, info@boxmag.eu, Telephone: +40 799 553 345) of your decision to withdraw from this Agreement by means of an unequivocal statement (for example, a letter sent by post or e-mail). You can use the model withdrawal form, but it is not mandatory.
In order to meet the deadline for withdrawal from the Agreement, it is sufficient for you to send information regarding the exercise of your right to withdraw from the Agreement before the deadline for withdrawal from the Agreement.
Consequences of withdrawal from the Agreement
In the event of withdrawal from this Agreement, we shall reimburse to you all payments received from you, including the costs of delivery of the item (with the exception of additional costs resulting from the delivery method chosen by you other than the cheapest usual method of delivery offered by us), immediately, and in any event no later than 14 days from the day on which we were informed of your decision to exercise the right to withdraw from this Agreement. We will refund you using the same payment methods that you used for the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees in connection with this refund. We may withhold a refund until we have received the item or until you have provided us with proof of having sent it back, whichever occurs first.
Please send or hand over the item to us to the following address: Boxmag, Stefan cel Mare 131 street RO-725400 Radauti, Suceava,, immediately, and in any case no later than 14 days from the date on which you informed us about your withdrawal from this Agreement. The deadline is met if you send the item back before the expiry of the 14-day period. You will have to bear the direct costs of returning the item. You are only responsible for the diminished value of the item resulting from using it in a way other than it was necessary to establish the nature, characteristics and functioning of the item.
The right to withdraw from the Agreement by the Consumer is excluded in the case of:
- Contracts in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy his individual needs

VIII. Complaints regarding Goods
We are obliged to deliver Goods free from defects. The statutory right of liability for defects of the item sold (warranty for defects) according the law 365/2002 and Civil Code.
Anyone making a purchase from the Shop has the right to make a warranty claim.
Complaints can be submitted:

In the case of exercising the rights under the warranty – if we deem it necessary to consider the complaint, you are obliged to deliver the defective Goods to the postal address indicated above at our expense. If, due to the type of Goods or the way they are installed, the delivery of the Goods would be excessively difficult, you are obliged to make them available to us in the place where they are located. We undertake to respond to the complaint immediately, no later than within 14 days from the date of its submission.
In the submitted complaint, it is recommended to (1) provide information regarding the subject of the complaint, in particular the type and date of occurrence of the defect; (2) specification of the request regarding the method of removing the defect (replacement of the Goods with a new one, repair of the Goods, price reduction, withdrawal from the Agreement – if the defect is significant); and (3) providing contact details of the person submitting the complaint – this will facilitate and speed up the consideration of the complaint by the Store. The recommendations specified in the previous sentence are in the form of non-binding guidelines only and in no way affect the effectiveness of complaints submitted without providing the recommended information.
IX. Additional guarantees when selling Goods in the Store
Reko Packaging, Stefan cel Mare 131 street RO-725400 Radauti, Suceava is the owner of the Goods available in the boxmag.eu Store. Reko Packaging as a manufacturer provides an additional guarantee for the Goods it produces on the terms and for the period specified in the warranty card attached to the Goods. The guarantee provided by us does not exclude, limit or suspend the Customer's rights resulting from the provisions on the warranty for defects of the item sold (Point VIII of the Regulations).
X. Complaints regarding the provision of electronic services
- Boxmag takes steps to ensure fully correct operation of the Online Store, to the extent that results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by Customers.
- The Customer may notify us of any irregularities or interruptions in the functioning of the Online Store website. Irregularities related to the functioning of the Store should be reported electronically to the
following address: info@boxmag.eu. - In a complaint regarding irregularities related to the functioning of the Online Store website, please indicate the type and date of occurrence of irregularities.
- We undertake to respond to the complaint immediately, no later than within 14 days from the date of its
submission.
XI. Out-of-court complaint and redress procedures
- Please be advised that there are possibilities of using out-of-court complaint and redress methods. Their use is voluntary and can only take place if both parties to the dispute agree. The consumer may apply for the initiation of proceedings for out-of-court resolution of consumer disputes regarding the concluded Sales Agreement to the Trade Inspection. The European Commission also provides a platform for online dispute resolution between Consumers and Entrepreneurs (ODR platform). It is available at: https://ec.europe.eu/consumer/odr
XII. Final provisions
- The court competent to settle disputes with Consumers is the court competent locally according to the applicable provisions of the Code of Civil Procedure.
- Settlement of any disputes arising between the boxmag.eu and the Customer who is not a Consumer is submitted to the court competent for our registered office.
