Regulations

I. Definitions

The terms used in the Regulations shall mean:

  1. Customera natural person, legal person, or organizational unit without legal personality, granted legal capacity by specific provisions, who places an Order as part of the Store.
  2. Consumerdefined in accordance with Civil Code, law 287/2009, as a natural person who concludes a legal transaction with an entrepreneur not directly related to their business or professional activity.
  3. Civil Coderefers to Law 287/2009 and subsequent amendments.
  4. Regulationsthese Regulations define the general terms and conditions of sale and the rules for the provision of electronic services as part of the boxmag.eu Online Store.
  5. Online Store (Store)an online service available at boxmag.eu, through which the Customer may place Orders.
  6. Goodsrefers to products presented in the Online Store.
  7. Sales Agreement (Agreement)a contract for the sale of Goods within the meaning of the Civil Code, concluded between boxmag.eu and the Customer, using the Store's website.
  8. Consumer Rights Actrefers to Law 363/2007, directive 85/577/CEE on consumer rights.
  9. Act on the provision of electronic servicesrefers to law 365/2002, regarding electronic services.
  10. Orderthe Customer's declaration of intent, aimed directly at the conclusion of the Sales Agreement, specifying in particular the type and quantity of the Goods.

II. General provisions

  1. These Regulations define the rules for using the Online Store available at boxmag.eu.
  2. These Regulations are the Regulations referred to in law 365/2002 (as amended) regarding electronic services.
  3. boxmag.eu is part of REKO Packaging s.r.l., Stefan cel Mare 131 street, 725400 Radauti, Suceava, VAT NR. RO4534966, registered at the Chamber of Commerce with nr. J33/1437/1993.
  4. These Regulations define in particular: the rules for registering and using an account as part of the Online Store; the terms and conditions for placing Orders electronically as part of the Online Store; the rules for concluding Sales Agreements using the services provided as part of the Online Store.
  5. In accordance with applicable law, boxmag.eu reserves the right to limit the provision of services via the Online Store to persons over the age of 18. In this case, potential customers will be notified.
  6. Customers can access these Terms and Conditions at any time via a link on the home page of the boxmag.eu website and download and print them.

III. Rules for using the Online Store

  1. Registration in the Online Store is optional. Registration requires accepting the regulations and providing mandatory personal data. Boxmag.eu may revoke a customer's right to use the store if the customer provides untrue data, infringes on third-party personal rights, or engages in behaviour inconsistent with applicable law or harming Boxmag.eu's reputation. A deprived user cannot re-register without prior consent.
  2. In order to ensure the security of the transmission of messages and data, the Online Store implements technical and organizational measures to prevent unauthorized persons from obtaining and modifying personal data transmitted via the internet.
  3. The Customer is obliged in particular to: use the Online Store in a manner consistent with Romanian law, the regulations, and general internet principles; not provide or transfer prohibited content (e.g. promoting violence, defamation, violating personal rights); use the Online Store without interfering with its functioning, in particular not using specific software/devices or sending unsolicited commercial information (spam); use the Online Store in a way that is not inconvenient for other customers and for Boxmag.eu; use any content posted as part of the Online Store only for personal use.
  4. The customer agrees to receive invoices in an electronic version.

IV. Procedure for concluding a Sales Agreement

  1. Initial selection: Go to boxmag.eu, select goods, and follow on-screen instructions.
  2. Adding to basket: Selecting goods involves adding them to a basket.
  3. Order modification: Customers can modify entered data and selected goods before confirming the order, guided by website information.
  4. Order summary display: After providing necessary data, an order summary will be shown, including goods/services description, total price, and other costs.
  5. Order confirmation: Accepting regulations, providing mandatory personal data, and pressing the confirmation button sends the order.
  6. Agreement conclusion: Goods information is an offer; sending an order is a declaration to conclude a sales agreement with boxmag.eu according to the regulations. The agreement is concluded upon receipt of the order by the online store's IT system, followed by email confirmation of essential elements.
  7. Customers can access, download, and print Terms and Conditions via a homepage link. Confirmation of essential sales agreement provisions occurs via email.

V. Delivery

  1. Delivery is carried out according to information at: https://boxmag.eu/en/content/delivery.
  2. Delivery costs will be indicated during order placement and finalized in the basket.
  3. Store pickup is available from Boxmag, Stefan cel Mare 131 street RO-725400 Radauti, Suceava, Monday to Friday 8:00–16:30, excluding public holidays.
  4. Orders can be picked up after prepayment and an email confirming readiness.
  5. Orders are processed only after payment confirmation.
  6. Paid orders are processed Monday to Friday during warehouse working hours.
  7. Order completion depends on stock availability. Estimated delivery times are in product cards. 24-hour shipping executes by the next business day; up to 5 business days shipping executes by the fourth business day. Final delivery time depends on the carrier and delivery location.
  8. For consumer distance purchases, damage to goods during delivery: the store bears the risk. Report obvious damage to the deliverer and contact the store. Delays in reporting do not affect statutory claims but faster notification helps in claims against the carrier.
  9. For non-consumer customers, the risk of damage or loss transfers from the online store to the buyer when goods are entrusted to a carrier designated by the buyer.

VI. Prices and payment methods

  1. The prices of the Goods are quoted in RON and EUR in accordance with the User's settings. Payments are accepted in currencies that the User chooses from the available list in the Store in accordance with their preferences.
  2. All prices include VAT.
  3. The Customer has the option of paying for the Order with the payment methods listed in the How to buy tab available at https://boxmag.eu/en/content/how-to-buy.
  4. The Order Fee is charged after placing the Order.
  5. Only paid Orders are accepted for execution.

VII. Right of withdrawal

You have the right to withdraw from this Agreement within 14 days without giving any reason. The withdrawal period expires 14 days after the date on which you came into possession of the last batch or part or on which a third party other than the carrier and indicated by you came into possession of the last batch or part.

To exercise your right of withdrawal, you must inform us (Boxmag, Stefan cel Mare 131 street RO-725400 Radauti, Suceava, info@reko-packaging.ro, Telephone: +40 799 553 345) of your decision to withdraw from this Agreement by means of an unequivocal statement (for example, a letter sent by post or e-mail). You can use the model withdrawal form, but it is not mandatory.

To meet the deadline for withdrawal from the Agreement, it is sufficient to send information regarding the exercise of your right to withdraw before the deadline.

Consequences of withdrawal from the Agreement

All payments, including delivery costs (excluding additional costs from non-cheapest delivery methods), will be reimbursed within 14 days of being informed of the withdrawal. The refund will use the same payment methods, and no fees will be incurred. A refund may be withheld until the item is received or proof of shipment is provided.

Return address: Boxmag, Stefan cel Mare 131 street RO-725400 Radauti, Suceava. The item must be sent or handed over immediately, and no later than 14 days from the date of withdrawal notification. The deadline is met if the item is sent before the 14-day period expires. The consumer will bear the direct costs of returning the item and is only responsible for the diminished value if the item was used in a way unnecessary to establish its nature, characteristics, and functioning.

The right to withdraw from the Agreement by the Consumer is excluded in the case of:

  • Contracts in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer's specifications or serving to satisfy his individual needs.

VIII. Complaints regarding Goods

The seller is obliged to deliver Goods free from defects. The statutory right of liability for defects of the item sold (warranty for defects) applies according to law 365/2002 and the Civil Code. Anyone making a purchase from the Shop has the right to make a warranty claim.

Complaints can be submitted:

If a complaint needs consideration under warranty, the customer is obliged to deliver the defective Goods to the postal address indicated above at our expense. If, due to the type of Goods or the way they are installed, the delivery of the Goods would be excessively difficult, you are obliged to make them available to us in the place where they are located. We undertake to respond to the complaint immediately, no later than within 14 days from the date of its submission.

Recommended information when submitting a complaint: (1) provide information regarding the subject of the complaint, in particular the type and date of occurrence of the defect; (2) specification of the request regarding the method of removing the defect (replacement of the Goods with a new one, repair of the Goods, price reduction, withdrawal from the Agreement if the defect is significant); (3) providing contact details of the person submitting the complaint. These recommendations will facilitate and speed up the consideration of the complaint by the Store. They are non-binding guidelines only and do not affect the effectiveness of complaints submitted without providing the recommended information.

IX. Additional guarantees when selling Goods in the Store

Reko Packaging, Stefan cel Mare 131 street RO-725400 Radauti, Suceava is the owner of the Goods available in the boxmag.eu Store. Reko Packaging as a manufacturer provides an additional guarantee for the Goods it produces on the terms and for the period specified in the warranty card attached to the Goods. The guarantee provided by us does not exclude, limit or suspend the Customer's rights resulting from the provisions on the warranty for defects of the item sold (Point VIII of the Regulations).

X. Complaints regarding the provision of electronic services

  1. Boxmag takes steps to ensure fully correct operation of the Online Store, to the extent that results from current technical knowledge, and undertakes to remove within a reasonable time any irregularities reported by Customers.
  2. The Customer may notify us of any irregularities or interruptions in the functioning of the Online Store website. Irregularities related to the functioning of the Store should be reported electronically to: info@reko-packaging.ro.
  3. In a complaint regarding irregularities related to the functioning of the Online Store website, please indicate the type and date of occurrence of irregularities.
  4. We undertake to respond to the complaint immediately, no later than within 14 days from the date of its submission.

XI. Out-of-court complaint and redress procedures

Possibilities exist for out-of-court complaint and redress methods, which are voluntary and require agreement from both parties. Consumers can apply for these proceedings regarding sales agreements to the Trade Inspection. The European Commission offers an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

XII. Final provisions

  1. The court competent to settle disputes with Consumers is the local court, as per the Code of Civil Procedure.
  2. Any disputes between boxmag.eu and a non-consumer customer are submitted to the court competent for their registered office.
